General Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following terms shall have the following meanings:
- Cooling-off period: the period within which the consumer can make use of his right of withdrawal.
- Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
- Day: calendar day.
- Duration transaction: a distance contract relating to a series of products and/or services, whereby the delivery and/or purchase obligation is spread over a certain period of time.
- Durable medium: any means with which the consumer or entrepreneur can store information and later consult it unchanged.
- Right of withdrawal: the possibility for the consumer to cancel the distance contract within the cooling-off period.
- Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers.
- Distance contract: a contract concluded through a system organized by the entrepreneur for distance selling, whereby only distance communication techniques are used.
- Distance communication technology: a means of concluding an agreement without the consumer and entrepreneur physically coming together.
- General Terms and Conditions: these general terms and conditions of the entrepreneur.

Article 3 – Applicability
- These general terms and conditions apply to every offer from the entrepreneur and to every agreement and order between the entrepreneur and the consumer.
- Before a distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed of this before the contract and can receive the terms and conditions free of charge upon request.
- If the agreement is concluded electronically, the text of these terms and conditions can be provided electronically in such a way that it can be easily stored on a durable data carrier.
- If specific product or service conditions apply in addition to these conditions, the consumer may, in the event of a conflict, invoke the provision that is most favourable to him.
- If any provision of these terms and conditions is found to be void or voidable, the remaining provisions shall remain in force and the invalid provision shall be replaced by a provision that approximates the original purpose as closely as possible.
- Situations not covered by these terms and conditions will be assessed in accordance with the spirit of these terms and conditions.
- Any ambiguities regarding the interpretation or content of a provision shall be interpreted in accordance with the spirit of these general terms and conditions.
Article 4 – The offer
- If an offer has a limited period of validity or is subject to conditions, this will be clearly stated in the offer.
- The offer is without obligation. The entrepreneur may change or withdraw the offer.
- The offer contains a clear and accurate description of the products and/or services. Images give a true representation of the products and/or services.
- Obvious mistakes or errors in the offer do not bind the entrepreneur.
- Each offer contains information that helps the consumer understand what his rights and obligations are upon acceptance, such as:
- The price including taxes;
- Any shipping costs;
- The manner in which the agreement is concluded;
- Whether or not the right of withdrawal applies;
- The method of payment, delivery and execution;
- The period for acceptance of the offer and the validity of the price;
- Whether the agreement will be archived and how it can be consulted;
- The languages in which the agreement can be concluded.
Article 5 – The agreement
- The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set.
- If the consumer orders electronically, the entrepreneur will immediately confirm receipt of the order electronically.
- The entrepreneur shall take appropriate technical and organizational measures to secure electronic data transfer.
- The entrepreneur may, within legal frameworks, check whether the consumer can meet his payment obligations and may, for well-founded reasons, refuse an order or impose additional conditions.
- The entrepreneur provides upon delivery:
- Instructions for reporting complaints;
- The conditions for and method of revocation;
- Warranty and service information;
- The data referred to in Article 4, unless these have already been provided before the agreement.
Article 6 – Right of withdrawal
- The consumer can terminate an agreement regarding the purchase of a product within 14 days without giving reasons. The term starts the day after receipt of the product.
- During the cooling-off period, the consumer will handle the product and packaging with care. He may only unpack or use the product to the extent necessary to assess whether he wants to keep it.
- If the consumer exercises his right of withdrawal, he shall notify the entrepreneur of this within 14 days of receipt by e-mail or in writing.
- The consumer returns the product within 7 days of this notification and demonstrates that it was shipped on time, for example by providing proof of shipment.
- If the consumer has not returned the product after the term has expired, the purchase is final.
Article 7 – Costs in case of revocation
- The consumer bears the costs of return shipping.
- If the consumer has paid an amount, the entrepreneur will refund this within 14 days after cancellation, provided that the product has been returned in good condition.
Article 8 – Exclusion of the right of withdrawal
The entrepreneur can exclude the right of withdrawal for:
- Products:
- That are tailor-made for the consumer;
- That spoil quickly or have a limited shelf life;
- Which cannot be returned for hygienic reasons if the seal has been broken.
- Services:
- The performance of which has begun with the consumer's consent before the end of the cooling-off period.
Article 9 – The price
- Prices in the offer include VAT.
- The entrepreneur may change prices as a result of legal measures.
Article 10 – Conformity and warranty
The entrepreneur guarantees that the products and services comply with the agreement, the reasonable requirements of soundness and the legal provisions.
